This article clarifies the copyright ownership of artificial intelligence, Combined with the status quo of the attribution of artificial intelligence creations to analysis. Using the analytical methods of law and economics, transaction cost theory concludes that user ownership can reduce transaction costs more. Compared with investors, the positive externality benefits exerted by the ownership of user rights in the externality theory are more obvious. From the perspective of game theory, the rights of artificial intelligence creations belong to the users, which are more conducive to promoting the development of artificial intelligence technology, it is more practical and feasible to attribute the rights of artificial intelligence creations to users.
